These Terms of Service ("Terms") govern your use of our website, services, and any travel arrangements made through our tour operator services. By accessing our website, making a booking, or using our services, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, please do not use our services. These Terms constitute a legally binding agreement between you and fortunznlq B.V.

Our services are subject to availability and may be modified or discontinued at any time. We reserve the right to refuse service to anyone for any lawful reason.

4. Booking and Payment Terms

4.1 Booking Process

• All bookings are subject to availability and confirmation
• A booking is confirmed only when you receive written confirmation from us
• Prices are subject to change until booking confirmation
• We reserve the right to decline any booking request

4.2 Payment Terms

• A deposit is typically required to secure your booking
• Full payment is due as specified in your booking confirmation
• Payments must be made in Euros (EUR) unless otherwise agreed
• We accept major credit cards and bank transfers
• Additional charges may apply for late payments

4.3 Pricing

• All prices include applicable VAT unless stated otherwise
• Prices may be subject to currency fluctuations and surcharges
• Additional costs may apply for special requests or modifications
• Travel insurance costs are separate unless specifically included

5. Cancellation and Refund Policy

5.1 Customer Cancellations

Cancellation charges apply as follows:

• More than 60 days before departure: 10% of total cost
• 31-60 days before departure: 25% of total cost
• 15-30 days before departure: 50% of total cost
• 7-14 days before departure: 75% of total cost
• Less than 7 days before departure: 100% of total cost

5.2 Company Cancellations

We may cancel bookings due to:

• Insufficient participant numbers
• Force majeure events or safety concerns
• Supplier cancellations beyond our control
• Government restrictions or advisories

In case of company cancellation, we will provide a full refund or offer alternative arrangements where possible.

6. Travel Documents and Requirements

6.1 Customer Responsibilities

• Ensure valid passports and visas for all destinations
• Comply with health and vaccination requirements
• Obtain appropriate travel insurance
• Inform us of any medical conditions or special requirements
• Arrive punctually for all scheduled activities

6.2 Document Validity

• Passports must be valid for at least 6 months beyond travel dates
• Visa requirements are the customer's responsibility
• We are not liable for denied entry due to invalid documentation
• Additional costs for document-related delays are customer responsibility

7. Behaviour and Conduct

Customers must:

• Behave respectfully towards other travellers, guides, and locals
• Follow local laws, customs, and regulations
• Not engage in illegal, dangerous, or disruptive behaviour
• Follow safety instructions and guidelines
• Respect environmental and cultural preservation efforts

We reserve the right to remove customers from tours for inappropriate behaviour without refund. Costs of early return or additional arrangements are the customer's responsibility.

8. Limitation of Liability

8.1 General Limitations

Our liability is limited to the maximum extent permitted by law. We are not liable for indirect, incidental, special, or consequential damages including but not limited to loss of profits, data, or business opportunities.

8.2 Third Party Services

We act as intermediaries for third-party suppliers (airlines, hotels, transport companies). We are not liable for their acts, omissions, or failures. Our liability for supplier failures is limited to refunding amounts paid to us.

8.3 Maximum Liability

Our total liability for any claim shall not exceed the total amount paid by the customer for the specific service or booking in question.

9. Force Majeure

We are not liable for failure to perform due to events beyond our reasonable control, including:

• Natural disasters, severe weather, or environmental conditions
• War, terrorism, civil unrest, or political instability
• Government actions, travel restrictions, or border closures
• Pandemic or health emergencies
• Supplier failures or transportation disruptions
• Infrastructure failures or cyber attacks

In force majeure situations, we will make reasonable efforts to provide alternative arrangements or refunds where possible.

10. Intellectual Property

All content on our website and marketing materials, including text, images, logos, and designs, are protected by intellectual property rights owned by fortunznlq B.V. or our licensors.

You may not reproduce, distribute, modify, or create derivative works from our content without written permission. Unauthorised use may result in legal action.

11. Privacy and Data Protection

Your personal information is processed in accordance with our Privacy Policy and applicable data protection laws including GDPR. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

12. Dispute Resolution

12.1 Complaint Procedure

12.2 Mediation and Arbitration

Disputes that cannot be resolved through direct negotiation may be submitted to mediation or arbitration in accordance with Dutch law and the rules of the Netherlands Arbitration Institute.

12.3 Time Limitations

Claims must be submitted within one year of the completion of travel services or the date when the issue should reasonably have been discovered.

13. Governing Law and Jurisdiction

These Terms are governed by Dutch law. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the Dutch courts, specifically the courts of Breda, Netherlands.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely approximates the intent of the original provision.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated "Last updated" date. Continued use of our services after changes constitutes acceptance of the modified Terms. For significant changes, we may provide additional notice via email.

16. Entire Agreement

These Terms, together with our Privacy Policy and any specific booking conditions, constitute the entire agreement between you and fortunznlq B.V. regarding the use of our services. These Terms supersede all prior agreements, representations, and understandings.
